Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the KAKI.MU website, mobile experiences and related services (collectively, the “Platform”). KAKI.MU is operated from Port Louis, Mauritius. By creating an account, placing an order or otherwise using the Platform, you agree to these Terms.
1. The marketplace
KAKI.MU is a multi-vendor marketplace. Products listed on the Platform are offered by independent third-party sellers (“Sellers”). KAKI.MU provides the storefront, checkout, escrow, dispute resolution and (where elected) delivery via the KAKI fleet. KAKI.MU is not the seller of recordfor marketplace listings, except for items expressly sold by “KAKI Fleet”, “KAKI Direct” or other KAKI-branded storefronts, in which case KAKI.MU is the seller of record.
2. Accounts
You must be at least 18 years old and capable of entering into a binding contract under Mauritian law to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at hello@kaki.mu if you suspect unauthorised access.
3. Prohibited content & conduct
You agree not to list, request or transmit content that is unlawful under Mauritian law, infringes third-party rights, is fraudulent, deceptive, or that depicts hate speech, sexual exploitation or regulated goods (firearms, controlled substances, counterfeit currency, or items restricted by the Mauritius Revenue Authority). Sellers must comply with all applicable consumer-protection, tax, customs and labelling requirements.
4. Orders, escrow & buyer protection
When you place an order, you enter into a sale contract with the Seller. KAKI.MU collects your payment and holds the funds in escrow until you confirm delivery or the protection window expires. If something goes wrong, you may open a dispute from your Orders page within the protection window (typically 7 days after delivery for physical goods; specific windows may apply per category).
5. Dispute resolution
We encourage buyers and sellers to resolve issues directly through the in-platform messaging tools. If that fails, you may escalate to KAKI.MU via the dispute centre. KAKI.MU will review evidence from both sides and may issue a refund from escrow, instruct redelivery, or release funds to the Seller. Our decisions on escrow disputes are binding for the purposes of the escrow release only; they do not limit your other rights under Mauritian consumer law.
6. KAKI fleet delivery
Where a Seller elects the KAKI fleet for delivery, KAKI.MU acts as the carrier and is responsible for the parcel from pickup until delivery is confirmed. Where third-party logistics are used, the Seller and the relevant carrier remain responsible for delivery performance.
7. Fees
Buyers pay the price displayed at checkout. Sellers pay platform commissions, payout fees and (where applicable) fleet delivery fees as described in the Seller Plans. Fees may change with reasonable notice.
8. Intellectual property
The Platform, its design, the KAKI.MU name and logo, and all proprietary software are owned by KAKI.MU and its licensors. Sellers retain ownership of their listings and grant KAKI.MU a worldwide, royalty-free licence to host, display and promote them for the purposes of operating the marketplace. You may not copy, scrape or redistribute Platform content without permission.
9. Limitation of liability
To the maximum extent permitted by Mauritian law, KAKI.MU is not liable for indirect, incidental or consequential damages arising from marketplace transactions between buyers and Sellers. KAKI.MU’s aggregate liability to you for any claim relating to a transaction is capped at the value of that transaction. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Suspension & termination
We may suspend or close accounts that breach these Terms, that are used for fraud, or that present a risk to other users. You may close your account at any time from your account settings, subject to the completion of any open orders and dispute windows.
11. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Mauritius. The Supreme Court of Mauritius (Cour Suprême de l’île Maurice) has exclusive jurisdiction over any dispute that cannot be resolved through KAKI.MU’s dispute centre, save for any non-waivable consumer rights you may have in your country of residence.
12. Changes
We may update these Terms from time to time. Material changes will be announced on the Platform and, where you have an account, by email at least 14 days before they take effect.
